USCIS officially updated its Policy Manual on November 21, 2019

USCIS officially updated its Policy Manual on November 21, 2019, to include new rules for the EB-5 Investor Visa Program, the biggest changes are: increased minimum investment amounts, new targeted employment area (TEA) definitions, and designating authority of TEAs is taken away from the State and the United States Citizenship and Immigration Services (USCIS) will now be directly responsible for verifying the project is located in a qualified TEA.

First, the EB-5 investment amounts have increased from $500,000 to $900,000 if the project is located in a TEA, and from $1 million to $1.8 million for a project not located in a TEA. Since the investment amounts have not changed since the program’s inception an inflation study was conducted by the Department of Homeland Security (DHS) consulting with the Departments of State and Labor. The federal agencies determined that the increase will reflect the present-day dollar value of the original investment amount set in 1990 by the U.S. Congress. They have also added that every fifth year there will be an inflation correction to the dollar amount.

We want to inform all our investors that the minimum investment amount to apply for the EB-5 visa program continues at $500,000.

 

ASI Global and EB-5 Florida Hotels and Investment wants to let you know that on Friday, March 9, the new bill to reform the EB-5 program was put into circulation and that it is requested to change the current investment amount to $925,000 in zones with TEA designation and $1,025,000 in areas without TEA designation.

 

This proposal is estimated to be approved as soon as in the next 30 days. For this reason, ASI Global and EB-5 Florida Hotels & Investments recommends that all our investors who are determined to take the road to obtain the American residency through the EB5 program start the process immediately in order to apply with the current investment amount of $500,000.

USCIS Has Approved an Exemplar For Our Staybridge Suites Project and Granted Deference To All Our I-526 Applicants

The USCIS, United States Citizenship and Immigration Services office has approved our exemplar to the Staybridge Suites by Intercontinental Project located near the Miami International Airport. This means the project is in full compliance with EB5 requirements and will give deference to the applicant's estimates of actual job creation and economic analysis, the business plan, organizational documents, offering memorandum, and investment agreements. 

In other words, we are in compliance with all the requirements for EB-5 projects and the USCIS has granted our applicant's deference. This allows our applicants filing for a I-526 to have a much easier application process in order to receive their American Residency (Green Card). 

EB-5 Visa Program Investment of $500,000 Extended Until December 2017

President Trump has signed into law H.R. 601, a continuing resolution that funds the federal government through December 8, 2017, and thereby extends the EB-5 Regional Center Program beyond September 30, 2017.

The minimum investment amount of $500,000 required by the program stays the same, and through our Staybridge by Intercontinental and Fairfield Inn Suites by Marriott projects, we offer our investors the opportunity to apply for their EB-5 Visa under this amount. 

The EB-5 Regional Center Program extension comes with no further legislative changes at this time, though passage of an EB-5 reform bill before December 8 is possible.
